Senior Counsel - Employment and Labor Law

The Opportunity:
StubHub recently completed its IPO on the NYSE and operates as a global marketplace spanning 195 countries, 33 languages, and 49 currencies. That scale and public-company status raise the stakes on every employment decision we make — how we hire, pay, manage, discipline, and separate from people, and how we do it consistently across a global, multi-jurisdictional workforce.
We're looking for a Senior Counsel to build and lead the function that protects StubHub's people practices end-to-end. This is a hands-on role for someone who wants both the strategic seat — advising the C-suite and Board on workforce risk — and the operational depth of running matters, managing outside counsel, and getting into the details when it matters. You'll be the primary legal advisor to the CHRO and business leaders on all employment and labor matters, while also building the policies, training, and governance infrastructure a public company of our scale requires.

What You'll Do:
Strategic Advisory & Leadership
- Serve as StubHub's primary legal advisor on all employment, labor, and workforce matters, partnering directly with the CHRO, General Counsel, and senior business leaders
- Advise the executive team and, as needed, the Board on employment-related risk, litigation trends, and regulatory developments that could affect the business
- Act as a trusted, pragmatic business partner — translating complex legal risk into clear, actionable guidance that keeps the business moving
Employment Litigation & Dispute Management
- Own end-to-end management of employment litigation, arbitration, and administrative proceedings (EEOC, state fair employment agencies, DOL, NLRB, and international equivalents), from intake through resolution
- Lead workplace investigations into harassment, discrimination, retaliation, and misconduct allegations, ensuring findings are thorough, defensible, and consistently applied
- Manage relationships with outside employment counsel across jurisdictions, driving down spend while maintaining quality through smart matter allocation and clear escalation protocols
- Partner with Trust & Safety, Security, and HR Business Partners on sensitive terminations, reductions in force, and executive separations to minimize legal exposure
Policy, Compliance & Governance
- Design, implement, and continuously update global employment policies, handbooks, and codes of conduct that reflect current law and StubHub's culture
- Ensure compliance with wage-and-hour law (FLSA and state equivalents), exempt/non-exempt classification, meal-and-rest-break requirements, and independent contractor/worker classification rules across all jurisdictions where StubHub operates
- Monitor and operationalize compliance with leave laws (FMLA, state paid leave, and international equivalents), accommodation obligations under the ADA and comparable global frameworks, and pay transparency and pay equity requirements (including the EU Pay Transparency Directive and emerging U.S. state disclosure laws)
- Build and maintain a global employment law compliance calendar and audit program, proactively identifying gaps before they become incidents
- Partner with Immigration counsel (in-house or outside) to support visa sponsorship, global mobility, and cross-border hiring compliance
Labor Relations & Workforce Strategy
- Advise on labor relations strategy, including union avoidance, collective bargaining exposure, and works council engagement in jurisdictions where applicable (particularly across StubHub's European operations)
- Provide guidance on NLRA-protected concerted activity, employee organizing, and social media/workplace conduct policies that intersect with labor law
- Support M&A, expansion into new markets, and organizational restructuring with employment law diligence, integration planning, and works council/consultation requirements
Training, Culture & Manager Enablement
- Design and deliver manager and employee training on harassment prevention, discrimination, performance management, and documentation best practices
- Build practical, plain-language playbooks and decision trees that empower HR Business Partners and managers to handle routine employment questions confidently, escalating only what truly needs legal review
- Champion the use of AI-assisted tools for policy drafting, contract review, and matter tracking to increase the speed and consistency of legal support without sacrificing rigor
Cross-Functional Partnership
- Act as key advisor (and dual report) to the CHRO on all matters in this job description
- Partner closely with Total Rewards and Finance on pay equity analysis, compensation governance, and public-company disclosure obligations related to workforce data
- Work with People Operations to ensure employment policies are operationalized cleanly in the HRIS and applied consistently across geographies
- Collaborate with Communications and HR on sensitive workforce announcements, ensuring legal and reputational risk are addressed before external or internal messaging goes out
- Support the CLO and Compliance team on SEC and NYSE disclosure obligations tied to human capital management, as required of a newly public company
What You've Done:
Experience & Expertise
- J.D. and active bar membership in good standing (California or New York bar strongly preferred; additional state admission a plus)
- 10+ years of employment and labor law experience, including significant time at a law firm and in-house, ideally at a technology company, marketplace, or global consumer business
- Demonstrated experience leading an employment law function or team, including managing outside counsel relationships and litigation portfolios
- Deep substantive expertise across wage-and-hour law, discrimination and harassment law, leave and accommodation law, labor relations, and workforce classification, with working knowledge of international employment frameworks (EU, UK, and other markets where StubHub operates)
- Experience advising a public company or preparing a company for public-company employment law standards, including human capital disclosure requirements
- Track record of building or significantly modernizing employment policies, training programs, and compliance infrastructure from the ground up
- Experience partnering with Total Rewards or Compensation teams on pay equity and pay transparency compliance

- High integrity and discretion when handling sensitive, confidential workforce matters
- Collaborative and low-ego; builds trusted partnerships across Legal, HR, Finance, and business leadership rather than operating as a silo
- Comfort evaluating and deploying AI-powered legal tools as genuine productivity multipliers, with the judgment to know where human review is non-negotiable

The anticipated gross base pay range is below for this role. Actual compensation will vary depending on factors such as a candidate’s qualifications, skills, experience, and competencies. Base annual salary is one component of StubHub’s total compensation and competitive benefits package, which includes equity, 401(k), paid time off, paid parental leave, and comprehensive health benefits.

$200,000 - $235,000 USD
