Scope of the role:

The Head of Compliance role is the designated responsable du contrôle du respect des obligations (“RC”) and is based in Luxembourg. This is a 12 month Fixed Term Contract.

The Compliance Manager will report to the Group Compliance function for the day-to-day compliance responsibilities.

The Head of Compliance will have in-depth insight and working knowledge of the Compliance and AML/CTF requirements that apply to VASPs/CASPs in Luxembourg/EU. The Head of Compliance will be responsible for monitoring and testing the Firm’s policies and procedures. This role will also contribute to the success of the wider Group Compliance programme.

The Head of Compliance will be risk aware and sensitive to the unique challenges and risks posed by a dynamic and fast-paced crypto industry.

Roles and responsibilities:

MI Reporting

  • Prepare and draft materials for key committees i.e. Board of Managers and Group Legal, Compliance and Conduct Committee
  • Report Compliance and Financial Crime matters to Authorised Managers and into the Group Compliance function
  • Track and monitor Compliance key risk indicators

Business Advisory

  • Conduct ongoing regulatory horizon scanning and initial assessments on the impact of key regulatory change including EU MiCA, DORA and TFR
  • Lead on regulatory licence and registration applications e.g. CASP licensing under MiCA regulations
  • Contribute to the compliance, conduct and financial crime policies and training related to Luxembourg and EU specific requirements
  • Review marketing materials and other business initiatives to ensure regulatory compliance
  • Become an active member in the local crypto and compliance communities

Financial Crime

  • Contribute to the Financial Crime framework, including risk assessments, policies, training and testing
  • Advise the onboarding team on Luxembourg specific onboarding procedures including CDD/EDD, UBO thresholds, source of funds checks etc.
  • Ongoing monitoring of ML/TF risks in strategy, products and services
  • Contribute to the ongoing enhancement of the transaction monitoring framework
  • Investigate suspicious transactions related to client transactions
  • Complete SAR reporting to the appropriate Luxembourg Competent Authorities (e.g. CSSF, CRF, MoJ)

Surveillance

  • Review escalated trade and eComms surveillance alerts on crypto trading strategies
  • Advise on alert parameters and suitable behaviour modules enhancements
  • Investigate any suspicious activity related to market conduct of clients
  • Complete STORs reporting to the appropriate Luxembourg Competent Authorities (e.g. CSSF, CRF, MoJ)

Monitoring and Testing

  • Implement and execute  the outsourcing testing and monitoring programme for ML/TF activities undertaken by the parent company
  • Conduct ongoing monitoring of outsourcing key performance indicators
  • Escalate risks or issues on outsourcing to Authorised Managers and Board of Managers

Essential

  • In-depth knowledge of MiCA regulations
  • Interested in dynamic crypto-native environment
  • 10+ years experience in compliance and at least 24 months in cryptocurrency industry
  • Effective communicator with ability to advise on practical and business implications of regulations

Desirable

  • In-depth knowledge of DORA and TFR
  • Knowledge and insight into CSSF regulatory expectations and priorities
  • Fluent English and French speaker

Additional Notes

The above is not an exhaustive list of duties and you will be expected to perform different tasks as necessitated by your changing role within the company and the overall business objectives of the B2C2. Hybrid role with at least 3/4 days in Luxembourg Office.
